EU food supplements directive may be illegal

In April 2005, the EU Advocate General Geelhoed, senior adviser to the European Court of Justice, gave an opinion that ‘The Food Supplements Directive infringes the principle of proportionality….therefore it is invalid under EU law’. The Alliance for Natural Health and several other food supplement organisations saw this as a significant victory in their campaign to get the directive ruled illegal. It should be noted, however, that the Advocate General’s statement is not a legal ruling, which must come from the European Court of Justice Judges, who will probably make a ruling in June 2005.
