Justice for Allium sativum (garlic) tablets?

Germany has received a complaint from the European Court of Justice for selling Allium sativum (garlic) capsules as medicines. The European Commission, who put in the complaint, argues that similar preparations in other member states are on the market as nutritional supplements and not medicines. The Commission also complained about the measure that hospitals can only obtain medicinal products from local pharmacies, which constitutes a breach of the free movement of goods act.
